September 14, 2012 Stephen Darcy 1234 Fairview Way Glenwood, CA 49283 Mayor Paul Stinson 100 Municipal Drive Glenwood, CA 49283 Dear Mayor Stinson, I am writing concerning a local establishment that is in violation of City Ordinance 1234-0987, Nuisance. As you are aware, a restaurant called Pablo’s recently opened in the Canyon Cove shopping center, adjacent to the Shady Springs neighborhood. Pablo’s is a restaurant serving Latin American cuisine, which stays open until 10:00 p.m. on weeknights and 11:00 p.m. on weekends. Pablo’s has an outdoor seating area, where a mariachi band plays on Thursday, Friday, and Saturday nights. The city ordinance referenced states that no noise should be emitted that can be heard off of the property owner’s own premises during the hours of 10:00 p.m. and 7:00 a.m. However, Pablo’s allows their band to continue performing on the patio from 10:00 to 11:00 p.m. when they close on the weekend. This racket is quite a nuisance to the residents of Shady Springs, particularly those of us who have small children who go to bed long before that hour. We would like to request that the owner of Pablo’s be ordered to either close its outdoor seating area or at minimum discontinue the music on the patio after 10:00 on weeknights, as required by the ordinance. There are currently many other establishments in the area that have outdoor seating and occasional musical acts who perform. All the others have no problem complying with the ordinance, and their businesses have never suffered as a result. We appreciate your prompt attention to this matter.
