Dear Mr. Garcia,
I have made a number of complaints to Acme Realty Company regarding water damage and mold located in and around my apartment. Since you are the landlord, I wanted to extend my complaint to you so that you have the chance to take appropriate action.
Specifically, I have found mold spores located above the shower in the bathroom, as well as under the sink and in cabinets in the kitchen. It states clearly in the Landlord Responsibilities section of the lease:
“If, in Landlord's opinion, the Unit is so damaged as to be unfit for occupancy, and Landlord elects to make repairs, the rent provided in this Lease shall abate unless otherwise as provided by law during the period of time when the Unit is not fit for occupancy...”
Furthermore, it states in ARS 33-343 that:
“The lessee of a building which, without fault or neglect on the part of the lessee, is destroyed or so injured by the elements or any other cause as to be untenantable or unfit for occupancy, is not liable thereafter to pay rent to the lessor or owner unless expressly provided by written agreement...”
As I mentioned, I am writing directly to you in order to allow you the chance to rectify the situation. I would also like to point out that Arizona state law says that you are required to reply to this complaint within 5 days. If a reply is not received within 5 days, I will refuse payment of any further rent until such a time as the issue is resolved. Thank you for your time and assistance.
