Keep the virus in the same directory as the file. When you release the virus, don't include the file. If you accidentally remove the file and trigger your virus, then, yes, you'd have a problem.

You will also need to set up port forwarding on his router that forwards the port you are going to be using to his computer; that way you can send commands to his computer from anywhere with an internet connection. Also, I recommend hiding the folder you will be using by setting the folder's attributes to 22. (16 + 4 + 2; 16 is folder, 4 is System, 2 is Hidden). That way, the folder will be invisible.
